Terms of Service
By using Gabyly you agree to share responsibly and to respect the privacy of the children and families in your memories. These terms set out the simple, fair rules for using the service. Please read them, they explain what you can expect from us and what we expect from you.
Your content stays yours
You retain full ownership of everything you upload. We never claim any rights over your photos or videos. You grant us only the limited, technical permission needed to store, encrypt and deliver your shares to the people you choose, and that permission ends when the memory expires or you delete it.
Acceptable use
Gabyly is made for personal and family memories. You agree not to upload or share content that is illegal, that infringes someone else's rights, or that is harmful, abusive or exploitative, in particular any content that endangers a child. You also agree not to attempt to break, overload or reverse-engineer the service, or to use it to send spam or malware.
Your account & security
Keep your password safe and consider enabling two-step verification. You are responsible for activity that happens under your account. If you share a private link or its password, anyone who receives it may be able to view that memory until it expires, so share thoughtfully.
Service availability
We work hard to keep Gabyly reliable, but the service is provided on an "as is" basis. We may update, improve or occasionally interrupt features for maintenance, and we are not liable for losses arising from circumstances beyond our reasonable control. Always keep your own original copies of important memories.
Subscriptions, billing & cancellation
Paid plans (Lite and Premium) are billed monthly in advance and start with a 14-day free trial, you won't be charged until the trial ends, and you can cancel during the trial at no cost. After the trial, your first paid month is a minimum commitment and is non-refundable. From the second month onwards you can cancel at any time from your profile under "My subscription": your plan then stays active until the end of the current billing period and will not renew, with no further charge. Prices are shown in euro and include any applicable taxes; we will let you know in advance of any price change.
Suspension & termination
You can delete your account at any time from your profile settings. We may suspend or terminate accounts that violate these terms or that put other people at risk, and we will act on valid legal requests. On termination, your personal data and stored media are removed as described in our Privacy Policy.
Governing law & jurisdiction
Gabyly is operated by Gabyly SNC, Lugano, Switzerland. These Terms are governed by Swiss law, and any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the competent courts of the city of Lugano, Switzerland. If you are a consumer resident in the EU, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence.
Changes to these terms
We may update these terms as the service evolves. If we make a material change, we will take reasonable steps to let you know. Continuing to use Gabyly after an update means you accept the revised terms. Questions? Email hello@gabyly.com.

Gabyly uses only what it needs to work, plus optional functional storage to remember your preferences. We never use advertising or tracking cookies. Read our cookie policy
